TERMS  OF  USE  AND  COMPLAINTS

LEGALLY BINDING PRODUCT INFORMATION AND TERMS OF USE

These terms and conditions form an integral part of every purchase.

By submitting an order, the customer confirms having read and agreed to them in accordance with Section 1751 of the Civil Code.


1 / PRODUCT NATURE AND CHARACTERISTICS

The tiles sold are a handmade product.

The customer hereby acknowledges that:

  • individual pieces may exhibit natural variations in shade, pattern, texture, and dimensions,
  • such variations do not constitute a defect but are a characteristic of the handmade manufacturing process,
  • the tiles are made from a mixture of cement, mineral components, and pigments,
  • the tiles do not contain chipboard or any organic materials.
These natural variations do not give rise to a claim regarding defective performance.


2 / REQUIREMENT FOR PROFESSIONAL INSTALLATION

The Seller supplies only the material.

The Seller bears no liability for the installation, construction methods, or technical solutions employed.

The Customer is required to ensure professional installation by a person knowledgeable about the relevant standards and procedures, who will:

  • verify the suitability of the substrate,
  • perform proper gluing and grouting,
  • ensure compliance with all required curing and setting times,
  • apply waterproofing where required,
  • carry out the final surface treatment, including mandatory impregnation.

Defects arising after the goods have been accepted—specifically:

  • cracks caused by inadequate grouting,
  • damage caused by loading before the material has cured,
  • damage caused by the absence of impregnation or improper impregnation,
  • defects resulting from unprofessional installation methods,
  • are the sole responsibility of the Customer and do not constitute a defect in the goods themselves.


3 / MANDATORY IMPREGNATION – CUSTOMER'S LEGAL OBLIGATION

The Customer acknowledges that certain types of tiles require mandatory impregnation, without which the tiles cannot be used safely.

The Customer is required to:

  • use a suitable impregnation agent appropriate for the tile type,
  • apply the impregnation before the surface is put into use,
  • renew the impregnation in accordance with the impregnation manufacturer's recommendations.

Inadequate or missing impregnation may result in:

  • moisture penetration,
  • color changes,
  • stains and blotches,
  • surface damage.

Such damage does not constitute a product defect and precludes the filing of a warranty claim.


4 / CONDITIONS FOR PROPER USE AFTER INSTALLATION

The customer acknowledges and agrees that:

  • the surface must not be subjected to loads before the adhesive and grout have fully cured,
  • the product must not be used prior to the application of a sealer/impregnating agent,
  • failure to observe required curing or setting times may result in permanent damage.

Any damage resulting from these actions is the sole responsibility of the customer.


5 / POLISHING AND OTHER MODIFICATIONS PERFORMED BY THE CUSTOMER

If the customer or a third party performs:

  • polishing,
  • grinding,
  • chemical treatment,
  • surface resurfacing (sanding),
  • they acknowledge that the following may occur:
  • loss of pigment,
  • alteration of texture,
  • change in shade.

These changes result from the buyer's actions and do not constitute grounds for a claim regarding defective goods.


6 / CLAIMS PROCEDURE

The buyer is required to inspect the goods prior to installation.

A claim may only be made regarding:

  • a demonstrable manufacturing defect,
  • that was present on the goods at the time of receipt,
  • and was not caused by installation, handling, or use after receipt. Warranty claims do not cover:
  • defects caused during installation,
  • failure to follow the prescribed installation procedure,
  • defects caused by the absence of impregnation,
  • defects caused by incorrect, insufficient, or delayed impregnation,
  • natural variations and aesthetic differences inherent to the handmade nature of the tiles,
  • cracks caused by improper grouting,
  • defects resulting from delayed grouting,
  • any subsequent surface modifications (sanding, polishing),
  • defects resulting from inadequate waterproofing,
  • damage caused by moisture due to insufficient waterproofing,
  • defects arising after the goods have been accepted,
  • damage caused by maintenance methods or chemical products not recommended by the seller,
  • cracks caused by the substrate or the use of incorrect adhesive,
  • use in unsuitable conditions.

Claims cannot be made regarding tiles that have already been installed, as their condition cannot be objectively assessed independently of the installation process.

The seller bears no liability for costs associated with installation, remediation, renovation, or removal, as these works are not included in the scope of delivery.


7 / CUSTOMER CONSENT

By submitting the order, the customer confirms that:

  • they have familiarized themselves with all the information stated above,
  • they understand that they are responsible for proper installation, impregnation, and subsequent use,
  • they understand that the seller is not liable for damage caused by improper installation or impregnation,
  • they accept the terms and conditions in full as part of the purchase agreement.
